How it works
Overtime pay = overtime hours x hourly rate x multiplier. Under the federal Fair Labor Standards Act, non-exempt employees earn at least 1.5 times their regular rate for hours over 40 in a workweek. Double time is not federally required but is common in union contracts and required in California after 12 hours in a day. Your regular rate must include non-discretionary bonuses and shift differentials, which can push it above your base rate.

Is overtime taxed differently?
No separate rate applies. Overtime is wages; it is withheld with the rest of your paycheck. A federal deduction for overtime premium pay (2025 to 2028) is claimed on your tax return and does not change paycheck withholding.
Who is exempt from overtime?
Salaried employees in executive, administrative, professional, and certain sales or computer roles paid above the federal salary threshold, plus some industry exemptions. Being paid a salary alone does not make you exempt.
